1. Acceptance of Terms

By accessing Zuhar, you confirm that you are at least 13 years of age (or 18 years where required by local law), that you have read and understood these Terms, and that you have the legal authority to enter into this agreement. If you are using Zuhar on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration & Eligibility

• You must provide accurate, complete, and current registration information
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately at support@zuhar.co of any unauthorized access to your account
• One person may not maintain more than one free account
• Accounts may not be transferred or sold to another individual or entity
• Zuhar reserves the right to refuse registration at its discretion

3. Platform Use & Conduct

You agree to use Zuhar only for lawful purposes. You must not:

• Publish, schedule, or distribute content that is illegal, defamatory, obscene, hateful, or infringes upon third-party rights
• Infringe upon any copyright, trademark, patent, or other intellectual property rights
• Use Zuhar to spam, phish, or conduct fraudulent activity on any connected platform
• Attempt to gain unauthorized access to any part of the Platform or its infrastructure
• Use automated bots or scripts to scrape, extract, or abuse the Platform
• Impersonate any person or entity
• Violate the terms of service of any social media platform you connect to Zuhar
• Use the Platform in any way that could damage, disable, or impair our services

You are solely responsible for all content published through Zuhar, including ensuring it complies with applicable laws, advertising standards, and platform-specific policies.

4. OAuth Connections & Social Platform Integrations

• Zuhar connects to third-party social media platforms via their official OAuth APIs
• By connecting your social accounts, you authorize Zuhar to act as a scheduling and analytics vehicle on your behalf, using only the permissions you explicitly grant
• Zuhar is not responsible for changes to third-party APIs, platform policy updates, rate limiting, or account suspensions imposed by social media platforms
• Social platform outages, API deprecations, or feature changes may affect Zuhar functionality — we will communicate known impacts but cannot guarantee uninterrupted third-party integration
• You may disconnect any social account at any time from your Zuhar settings

5. AI-Generated Content

• Zuhar provides AI tools to assist with content creation including caption generation, hashtag suggestions, hooks, and content ideas
• AI-generated content is provided as a starting point and may be inaccurate, incomplete, or inappropriate for your specific context
• You are fully responsible for reviewing, editing, and approving all AI-generated content before publishing
• Zuhar does not guarantee that AI-generated content is original, factually accurate, or free from copyright issues
• You retain ownership of content you create using AI assistance on the Platform, subject to the underlying AI provider's terms

6. Subscription Plans & Billing

• Zuhar offers free and paid subscription tiers with different feature access levels
• Paid subscriptions are billed on a monthly or annual basis as selected at checkout
• Subscription fees are charged in advance and are non-refundable except where required by applicable law
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• Zuhar reserves the right to modify pricing with at least 30 days' notice to existing subscribers
• Failed payments may result in temporary suspension of premium features until payment is resolved
• Coupon codes and promotional discounts are applied as specified at the time of redemption and may be subject to additional terms
• All payments are processed by Razorpay and are subject to their payment terms

7. Brand Marketplace Guidelines

The Zuhar Brand Marketplace connects creators with brands for sponsored collaborations. Both parties agree to the following:

For Creators:

• You represent that your follower metrics, engagement rates, and profile information are accurate and not artificially inflated
• You will deliver agreed-upon content on time and to the specifications outlined in the deal agreement
• You will comply with all applicable advertising disclosure requirements (e.g., ASCI guidelines, FTC rules)
• Failure to deliver agreed deliverables may result in payment disputes and account restrictions

For Brands:

• You will provide clear campaign briefs, timelines, and payment terms
• Payment must be deposited into escrow before a creator begins work
• You will review and approve deliverables within the agreed timeframe

Payment Protection (Escrow):

• Zuhar holds brand payments in escrow until deliverables are confirmed complete
• Disputes must be raised within 7 days of deliverable submission
• Zuhar's decision in disputes is final and binding
• Zuhar charges a platform commission of up to 15% on completed deals

8. Intellectual Property

• Your content: You retain full ownership of all content you create, upload, or publish through Zuhar
• License to Zuhar: By uploading content, you grant Zuhar a limited, non-exclusive license to store, display, and transmit your content solely for the purpose of providing the Platform's services
• Zuhar's IP: The Zuhar platform, brand, logo, software, AI models, and all associated intellectual property are owned exclusively by Zuhar and may not be copied, modified, or redistributed without written permission
• "Powered by Zuhar" branding: Free plan users' public profiles display "Powered by Zuhar". This branding may be removed on paid plans.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Zuhar shall not be liable for:

• Any indirect, incidental, consequential, or punitive damages arising from your use of the Platform
• Loss of revenue, followers, brand deals, or business opportunities
• Data loss due to third-party API failures or social platform changes
• Delays, errors, or failures caused by social media platform outages or API rate limits
• Content published in error due to user misconfiguration of scheduling settings
• Unauthorized access resulting from your failure to secure your account credentials

Zuhar's total aggregate liability for any claim shall not exceed the amount paid by you to Zuhar in the three months preceding the claim.

10. Disclaimers

Zuhar is provided on an "as is" and "as available" basis. We do not warrant that:

• The Platform will be uninterrupted, error-free, or fully secure at all times
• AI-generated content will be accurate, original, or suitable for your specific needs
• Using Zuhar will result in increased followers, engagement, monetization, or business success
• All features will be available at all times — features may be modified, limited, or discontinued with notice

11. Termination & Suspension

Zuhar reserves the right to suspend or terminate your account, with or without notice, if:

• You violate any provision of these Terms
• Your account is used for fraudulent, abusive, or illegal activity
• You engage in behavior that harms other users, brands, or the integrity of the Platform
• Chargebacks or payment fraud are detected on your account

Upon termination, your right to access the Platform ceases immediately. You may request export of your data within 30 days of account termination.

12. Governing Law

These Terms are governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India. If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

13. Changes to Terms

We may update these Terms periodically. Material changes will be communicated via email or prominent notice on the Platform at least 14 days before taking effect. Continued use of Zuhar after the effective date constitutes acceptance of the updated Terms.
